1. USE

ALMAGEA internetska stranica (www.almagea.hr) se može koristiti za Vašu privatnu upotrebu bez ikakvih naknada za korištenje. Korištenjem internetske stranice www.almagea.hr („Internetska stranica“) i internetske trgovine www.almagea.hr/shop („Internetska trgovina“) obvezujete se poštivati ove Opće uvjete prodaje („Opći uvjeti prodaje“).

Molimo Vas da sadržaj stranice Opći uvjete prodaje obavezno pažljivo pročitate prije korištenja Internetske stranice odnosno Internetske trgovine odnosno prije naručivanja proizvoda od Almagea d.o.o. elektroničkim putem. 2. TERMS OF PURCHASE

Naručivanjem proizvoda od Almagea d.o.o. elektroničkim putem i/ili korištenjem Internetske trgovine smatra se da ste upoznati s ovim Općim uvjetima i važećim cijenama proizvoda objavljenima stranici Dietary supplements te da iste prihvaćate. Almagea d.o.o. nije odgovorna za sporna pitanja koja bi eventualno mogla proizaći iz razloga što niste pročitali Opće uvjete.

The procedure, as well as the conditions of purchase/sale of products electronically and/or through the Internet store, are defined by the following parameters: order, shipment, payment, delivery, complaint of goods.

Almagea d.o.o. omogućuje kupcima kupnju proizvoda koji su navedeni u Internetskoj trgovini putem Internetske trgovine i putem narudžbe poslane elektroničkom poštom na almagea@transfer.almagea.hr. U smislu ovih Općih uvjeta, kupcem se smatra svaka osoba koja elektroničkim putem naruči barem jedan proizvod, a u slučaju kupnje putem Internetske trgovine, i popuni tražene podatke u obrascu za registraciju. Sve cijene proizvoda izražene su u eurima (EUR) s uključenim PDV-om.

3. ORDERING PRODUCTS

Products are ordered electronically, by e-mail or via the Internet store.

U slučaju naručivanja proizvoda elektroničkom poštom, roba se smatra naručenom u trenutku kada Almagea d.o.o. zaprimi narudžbu. Na email adresu s koje ste poslali narudžbu dobiti ćete potvrdu da je narudžba zaprimljena. Potvrda o zaprimanju narudžbe sadržava proizvode koje ste naručili i ukupnu cijenu narudžbe, kao i vezu (link) na ove Opće uvjete, čime se smatra da je Almagea d.o.o. ispunila obvezu dostave ugovora kupcu. Ukoliko ne zaprimite ovakvu potvrdu, molimo da nas kontaktirate na jedan od načina navedenih u izborniku Contact.

Kupnja proizvoda putem Internetske trgovine započinje odabirom opcije Dodaj u košaricu, čime se odabrani proizvod automatski sprema u košaricu. Kupnja proizvoda spremljenih u košaricu je moguća u svojstvu gosta ili u svojstvu registriranog korisnika, nakon unosa podataka o kupcu (podaci za naplatu) i o adresi za dostavu, koji će se automatski prikazati u košarici, odabirom opcije Dodaj u košaricu. Roba se smatra naručenom u onom trenutku kada kupac izvrši cijeli proces narudžbe. Na email adresu kojom ste se registrirali kao kupac dobiti ćete potvrdu da je narudžba zaprimljena. Potvrda o zaprimanju narudžbe sadržava proizvode koje ste naručili i ukupnu cijenu narudžbe, kao i vezu (link) na ove Opće uvjete, čime se smatra da je Almagea d.o.o. ispunila obvezu dostave ugovora kupcu. Ukoliko ne zaprimite ovakvu potvrdu, molimo Vas provjerite nalaze li se naručeni proizvodi u Vašoj košarici nakon prijave. Ukoliko je košarica prazna, ljubazno Vas molimo da nas kontaktirate na jedan od načina navedenih u izborniku Contact.

4. PURCHASE OPTIONS THROUGH THE INTERNET SHOP

When ordering a product through the Online Store, the customer chooses between a one-time purchase, by selecting the Add to cart option, and a subscription, by selecting the Subscribe option.

One time purchase

A one-time purchase means a one-time order of one or more products.

Subscription

The subscription relationship is established by ordering one or more products with the use of the Subscribe option, and is binding from the day when the confirmation of receipt of such order is sent to the customer until the end of the selected subscription period. The subject of the subscription contract is the delivery and delivery of the products covered by the subscription by Almagea d.o.o., with payment of the corresponding fee (subscription price) by the customer.

The customer chooses the duration of the subscription relationship by choosing from one of the options offered on the Online Store.

With the subscription, the customer gets a discount on the regular price of all products included in the subscription. The amount of the discount on the regular price of the product depends on the selected duration of the subscription.

The subscription price includes the discounted price of all products included in the subscription, including VAT.Import duties, customs clearance costs, taxes and fees related to the import of products are not included in the subscription price, but customers are obliged to check whether they exist and, if so, in what amount.

The subscription contract ends at the end of the selected subscription period.

5. PAYMENT FOR PRODUCTS

The customer pays for the products at the price specified in the order confirmation.

The subscription fee is paid monthly, before the products are shipped to the customer, for all products delivered to the customer during each month of the subscription period.

All prices are expressed and paid in euros.

Trošak dostave dodatno se zaračunava na cijenu proizvoda, prema Cjeniku dostave kojeg možete pronaći na stranici Više o načinu plaćanja i dostavi.

6.PRODUCT SHIPMENT

Naručeni proizvodi biti će složeni i zaštićeni kako bi se spriječila moguća oštećenja prilikom transporta. Kupac je dužan prilikom preuzimanja naručenih proizvoda provjeriti moguća oštećenja te ih odmah reklamirati dostavljaču, te vratiti isporučene proizvode na kojima su vidljiva vanjska oštećenja. U suprotnom, naknadne reklamacije se ne uvažavaju.

7. PRODUCT DELIVERY

The delivery of the product is considered to be the handing over of the products included in the individual order or subscription to the customer or to a third party designated by the customer.

We deliver all ordered products via the contracted courier service. The delivery price depends on the value of the ordered goods.

U slučaju da kupac iz neopravdanog razloga odbije primiti dostavu proizvoda ili ne preuzme proizvod od ugovorene kurirske službe za dostavu te se proizvod vrati na adresu Almagea d.o.o., Almagea d.o.o. ima pravo od kupca naplatiti troškove povrata proizvoda sukladno važećem cjeniku kurirske službe, a temeljem dokaza o nastalom trošku dostave i računa kojeg će Almagea d.o.o. ispostaviti kupcu po navedenoj osnovi, s dospijećem od 15 dana. 8.CLAIM AND RETURN OF PRODUCTS

In case of product return, the buyer is obliged to send a justified complaint to the delivery person. The customer has the right to return the product in the following cases:

delivery of a product that was not ordered or included in the subscription
delivery of a product that has a fault or damage
if the consumer's right to return the product is prescribed by mandatory regulations.

Please compare the received items with the invoice and if something is missing, immediately notify your delivery person.

9. INQUIRIES AND COMPLAINTS

U slučaju da imate upit ili pritužbu u vezi kupnje proizvoda iz našeg asortimana elektroničkim putem (Internetska trgovina i email narudžba), molimo da istu uputite na almagea@transfer.almagea.hr. Almagea d.o.o.will respond to your inquiry or complaint as soon as possible, as well as take all reasonable measures to eliminate the reasons for which the complaint was made.

10. UNILATERAL TERMINATION OF THE AGREEMENT

Kupac ima pravo u roku od 14 dana od dana dostave jednokratno naručenih proizvoda odnosno, u slučaju pretplate, od dana prve dostave proizvoda, jednostrano raskinuti ugovor o kupnji proizvoda / pretplatnički ugovor putem Internetske trgovine ili elektroničkom poštom poslanom na almagea@transfer.almagea.hr, without giving a reason ("unilateral termination of the contract"). Upon expiry of the specified period, the customer loses the right to unilaterally terminate the contract.

In the event that the same delivery includes several pieces of products that are part of the same delivery, but are delivered to the customer separately or in several shipments, the term for unilateral termination of the contract starts from the date of delivery of the last shipment that is part of the same delivery. In the case of a subscription, all products delivered to the customer for a particular month of the subscription period are considered part of the same delivery.

Kupac mora obavijestiti Almagea d.o.o. o korištenju prava na jednostrani raskid ugovora prije isteka roka za jednostrani raskid i to jasnom i nedvosmislenom pisanom izjavom upućenom preporučenom poštanskom pošiljkom na adresu sjedišta Almagea d.o.o. ili elektroničkom poštom poslanom na almagea@transfer.almagea.hr, u kojoj će navesti svoje ime i prezime, adresu, kontakt broj telefona ili adresu elektroničke pošte, datum narudžbe odnosno zasnivanja pretplate te naziv i količinu proizvoda za koje kupac koristi pravo na jednostrani raskid ugovora. Za jednostrani raskid ugovora možete koristiti i obrazac izjave kojeg možete vidjeti u ovom document.

Almagea d.o.o.will without delay, to the e-mail address specified by the buyer in the declaration of unilateral termination of the contract or, if the buyer did not specify it in the declaration of unilateral termination, to the e-mail address of the buyer specified when ordering the product, will deliver to the buyer a confirmation of receipt of the declaration of termination.

In case of unilateral termination of the contract, the parties are not obliged to fulfill their obligations from the terminated purchase contract / subscription contract, i.e. they are required to return to each other everything they received on the basis of the contract unilaterally terminated by the buyer.

The customer must return the product without delay, and no later than within 14 days of sending the notice of termination given in accordance with these General Terms and Conditions. The customer bears the direct costs of returning the product to the address of Almagea d.o.o. headquarters.

Smatra se da je Kupac izvršio obvezu vraćanja proizvoda na vrijeme ako prije isteka prethodno navedenog roka pošalje proizvod na adresu sjedišta Almagea d.o.o. te dostavi dokaz o slanju proizvoda na sjedište Almagea d.o.o. elektroničkom porukom poslanom na almagea@transfer.almagea.hr ili ako proizvod osobno preda na adresu sjedišta Almagea d.o.o. Kupac je odgovoran za svako umanjenje vrijednosti proizvoda koje je rezultat rukovanja proizvodom, osim onog koje je bilo potrebno za utvrđivanje prirode, obilježja i funkcionalnosti proizvoda.

Almagea d.o.o. će izvršiti povrat plaćenog nakon što proizvodi budu vraćeni, odnosno nakon što Kupac na almagea@transfer.almagea.hr dostavi dokaz da je proizvode poslao na adresu sjedišta Almagea d.o.o., ako je predmetni dokaz dostavljen prije primitka proizvoda.

If the product is returned defective, with major damages or without parts and documentation, and if the same is not delivered within a subsequent period of 8 days, it is considered that the customer has not fulfilled his obligation to return the product and Almagea d.o.o. is not obliged to return the paid funds.

Almagea d.o.o. will not reimburse additional costs resulting from the buyer's explicit choice of a type of transport that is different from the standard type of transport of products purchased electronically.

Almagea d.o.o. will refund the amount paid using the same means of payment used by the customer when paying, unless the customer expressly agrees to another means of payment and if the customer is not obligated to pay additional costs for such a refund.

The customer does not have the right to unilaterally terminate the contract if:

Almagea d.o.o.fully fulfilled the contract, and the fulfillment began with the explicit prior consent of the buyer and with his confirmation that he is aware of the fact that he will lose the right to unilaterally terminate the contract if the contract is fully fulfilled
subject of the contract are goods or services whose price depends on changes in the financial market that are beyond the influence of Almage d.o.o., and which may occur during the duration of the customer's right to unilaterally terminate the contract
the subject of the contract is a product made according to the customer's specification or clearly adapted to the customer
the subject of the contract is a perishable product or a product that quickly expires
the subject of the contract is sealed goods that are not suitable for return due to health or hygiene reasons, if they were unsealed after delivery
met any of the reasons for which the customer is excluded from the right to unilateral termination in accordance with the Consumer Protection Act.

11. LIABILITY FOR MATERIAL DEFECTS

Almagea d.o.o. is responsible for material defects of products purchased via the Internet store, i.e. electronically in accordance with the Obligatory Relations Act and the Consumer Protection Act, in the currently valid text of those regulations.

12. RESOLUTION OF DISPUTES

In the event of a dispute arising from or in connection with the purchase of products via the Internet store, i.e. electronically, an application may be submitted to the Court of Honor of the Croatian Chamber of Commerce or a proposal for conciliation at the conciliation centers, in accordance with the rules of procedure of these bodies.

13. PROTECTION OF PERSONAL DATA

Almagea d.o.o. undertakes to protect the privacy and confidentiality of the personal data of its customers and users of the website, including the online store.

Almagea d.o.o., as a data processing manager, collects only those personal data that customers/users provide themselves and that are necessary to achieve the purpose for which they were provided.

Collected personal data is used for the purpose of selling products through the Internet store, i.e. electronically, delivering purchased products, responding to customer/user inquiries, contacting customers/users and improving our products and services, as well as for other related purposes. By submitting your personal data, you declare your consent to their collection, processing, use and, when an adequate level of personal data protection is guaranteed, forwarding in accordance with the goal and purpose for which they were submitted to us, as well as in accordance with positive national regulations.

All collected personal data is strictly protected and is available only to employees and business partners who need this data for the aforementioned purposes. All employees and business partners are responsible for respecting the principles of privacy protection and confidentiality of personal data.

14. REGISTRATION

Registracija na Internetsku trgovinu i kupnju proizvoda putem iste je moguća u svojstvu gosta ili otvaranjem korisničkog profila, odabirom opcije „Moj profil“. Za registraciju na Internetsku trgovinu i kupnju proizvoda putem iste, morate imati najmanje 18 godina i poslovnu sposobnost. Kupac snosi odgovornost za točnost i potpunost unesenih podataka u obrascu za registraciju. Ukoliko promijenite podatke koje ste unijeli prilikom registracije, dužni ste ažurirati Vaš korisnički račun kako biste nas obavijestili o nastalim promjenama.

15. SECURITY

Prilikom registracije na Internetsku trgovinu bit ćete dužni kreirati korisničko ime i lozinku koju čuvajte i ne dijelite s drugim osobama. Odgovorni ste za sve akcije i narudžbe koje su naručene pod Vašom lozinkom. Ako znate ili sumnjate da još netko koristi Vašu lozinku, dužni ste nas obavijestiti o tome.

16. CHANGES

Almagea d.o.o. reserves the right to amend these General Terms and Conditions. We will notify all registered users of changes to the General Terms via the e-mail addresses they entered during registration.If you do not agree and do not accept these General Terms and Conditions, please contact us by email and during this time do not use the services of the Almage Online Store or the possibility of ordering our products via email.
